Update on the Charities Act 2006
Led by: Paul Pharaoh and Stephen Claus
Relevant to senior administrators and managers at HE and
FE institutions and Students’ Union.
Perhaps appropriately for the most fundamental
redefinition of charity law for four centuries, the new
Charities Act took several years to reach its final form. It is
still not fully in force, but the remaining parts are due to
come into effect in 2008. The assessment of public
benefit, which has generated most publicity, has centred
on public schools, but has found an echo in HE with free
marketers who question whether the benefits of charitable
status are outweighed by restraints on an institution’s
freedom to act as a business.
As well as the new definitions of charity, this session will
look at:
- how will the increased regulation of exempt charities
affect colleges and universities?
- how are HEFCE and the LSC setting about their new
roles as principal charity regulators for the sector?
- will the Charity Commission’s own powers impact
directly on institutions?
- will students’ unions need to register with the Charity
Commission, and if so what changes will that involve?
- how are students’ unions legally constituted at
present, and should or must they change their status
by becoming incorporated bodies?
